Utility · Terms
The terms a project runs on.
Written to be read. If anything here does not suit your situation, say so before we start rather than after.
In detail.
Who the agreement is between
You, the client, and Alex Website Automations, an independent one-person studio. The agreement for any given project is the written quote and scope I send you, together with this page.
What is supplied
A website built to the scope agreed in writing before work starts. A focused project is $500 to $700 AUD. The scope names the pages, what gets built and what is out of scope, so both of us are working from the same description of the job.
What you supply
Your content, any images you hold the rights to, access to your domain where it is needed, and timely feedback. Where a project stalls waiting on content, the schedule moves with it. If you supply images or copy, you confirm you have the right to use them.
Timelines
An estimated schedule comes with the quote. It assumes content and answers come back within a few days. It is an estimate made in good faith, not a guaranteed delivery date.
Revisions
The quoted price includes a review round: you read the site on a live link and mark up what is wrong or missing, and I fix it. Work that goes beyond the agreed scope is quoted separately and discussed before anything changes on the invoice. Nothing is added to a bill without being agreed first.
Ownership
On final payment, the site content and the delivered files are yours. I keep the right to show the finished work in my portfolio and to describe the work done. If you would rather I did not, tell me and I will not.
Hosting and domains
Domains and any paid third-party services are registered in your own name wherever possible, so you keep control of them. Their costs are yours and are billed to you directly rather than marked up through me.
What is not promised
No guarantee is made about search rankings, traffic volumes, enquiry numbers or sales. Anyone promising those is guessing. What is promised is a site built to the agreed scope, that works, that loads quickly, and that is straightforward to keep current.
Liability
Liability for any claim connected to a project is limited to the fee paid for that project. Nothing here excludes rights you have under the Australian Consumer Law, which cannot be contracted out of.
Cancellation
Either side can stop a project. If you cancel, work completed to that point is payable and the files for it are handed over. If I cannot complete a project, any amount paid for work not delivered is refunded.
Governing law
This agreement is governed by the law of the Australian state in which the studio operates, and disputes are dealt with in that jurisdiction.
